29 CFR 1926.760(a)(1): Except as provided by paragraph (a)(3) of this section, each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems: (a)Henry Carlson Construction, LLC at 14th Street and Minnesota Avenue, Sioux Falls, SD 57104: On or about and at times prior to May 12, 2020, the employer did not ensure employees engaged in steel erection activities were protected from fall hazards more than 15 feet above a lower level. On May 12, 2020, two employees were installing corrugated steel decking material on a steel truss overhang or "halo" on the roof of a seven story commercial building without the use of a fall protection system. An employee stepped between the steel trusses and attempted to stand on 5/8 DensGlass Gypsum sheathing that was attached to the bottom chord of the trusses and fell approximately 65 feet and died as a result. This condition exposed two employees to a fall hazard of approximately 65 feet.
