29 CFR 1926.502(b)(1): The top edge height of the top rails, or equivalent guardrail system members, was not 42 inches (1.1 m) plus or minus 3 inches (8 cm) above the walking/working level: At the fifth floor of a building in construction, located at 488 Sunny Isles Blvd., Sunny Isles Beach, Florida, 33160: On or about March 17, 2020, and at times prior, employees were exposed to a fall hazard of 55-feet to ground level, in that the height of the top rail on a balcony guardrail was 34-inches in height.
