OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to being struck by hazards where equipment repairs and modifications had been made without the manufacturer's approval: a) On or about February 3, 2020, and at times prior, employees were exposed to struck by hazards where a piece of a Ho-Pac Vibratory Plate Compactor/Driver had been repaired and modified without conducting an engineering analysis and evaluation to assure the repair and modification maintained the manufacturer's design and equipment's structural integrity. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
