29 CFR 1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access: 475 College Highway, Southwick, MA: On or about January 29, 2020, employees were observed using portable ladders to reach the upper landing surface (roof) that did not extend 3 feet past that upper landing surface. The employer routinely fails to assure effective protection against falls as required by the standard, as demonstrated on January 29, 2020, when employees were using ladders that did not extend 3 feet past the upper landing of the residential roof work area located at 475 College Highway, Southwick, MA with out fall protection. Employees were exposed to fall hazards of more than 15 feet above the next lower level (ground). Cesar Lopez was previously cited for a repeat violation of this occupational safety and health standard 29 CFR 1926.1053 (b) 1 which was contained in OSHA inspection number 122643, citation number 1, item number 3 and was affirmed as a final order on 7/17/2017, with respect to a workplace located at 17 Lindale St., Springfield, MA. Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29CFR1903.19(d)(1).
