29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. (a) J.G. Ewing Contractors Inc., DBA: E&K Contractors, on or about December 18th, 2019, at the location of 1848 E. Perry St., Port Clinton, OH, 43452: The employer did not ensure that employees working within a trench excavation were protected from excavated material falling back into the trench. Excavated material was piled directly up to the edge of the trench, exposing employees to potential struck by hazards from the material falling back into the trench.
