29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her work environment to control or eliminate any hazards or other exposure to illness or injury: (a)Slowey Construction, Inc. at Project adjacent to 885 Cottonwood Lane in Dakota Dunes, SD, 57049: On or about and at times prior to December 11, 2019, the employer did not ensure employees were protected from fire and struck-by hazards in that the employer did not ensure employees were instructed in the recognition and avoidance of unsafe conditions related to the operation of cut-off saws including but not limited to: (1) improper fuel cap installation; (2) cutting bell ended pipe; (3) side grinding; (4) compatibility of non-manufacturer branded blades; and (5) avoidance of blade/worksurface contact when cutting the workpiece on a flat surface. This condition exposed employees to struck-by and fire hazards.
