29 CFR 1910.147(f)(3)(i): When servicing and/or maintenance is performed by a crew, craft, department or other group, they shall utilize a procedure which affords the employees a level of protection equivalent to that provided by the implementation of a personal lockout or tagout device. (a) - On September 26, 2019, Kasto, Inc. did not ensure that when servicing and maintenance work, including troubleshooting, was performed by a maintenance crew, on equipment such as but not limited to the KASTO Unicompact 3.0 machine located at Bay 7 at Earl M. Jorgensen Company, 1900 Mitchell Blvd, Schaumburg, Illinois 60193, a procedure was utilized that would afford each employee a level of protection equivalent to that provided by the implementation of a personal lockout/tagout device. An employee suffered a fatal injury, during troubleshooting activities, on the KASTO Unicompact 3.0 system when the access door to the gated area was closed and reset causing the machine arm to move before all employees had safely exited the area. In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase, or repair of the equipment, photographic or video evidence of abatement, or other written records.
