29 CFR 1910.146(d)(3): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not develop and implement the means, procedures, and practices necessary for safe permit space entry operations, including, but not limited to items (d)(3)(i) through (d)(3)(vi) of this paragraph. Location: Elevator pit for Elevators # 1 and # 2, Trip Advisor Needham facility The employer did not develop an implement the means, procedures, and practices for safe entry into elevator pits thereby exposing an employee to a struck-by hazard on September 3, 2019. Instance A: The employer did not ensure that a Confined Space Entry Form was used to evaluate pits prior to their entry. Instance B: The employer did ensure that a barrier was used to prevent persons and objects from falling into the pit under Elevator car # 1.
