29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step: The employer does not ensure that employees are protected from falls while utilizing step ladders. This most recently occurred on August 28, 2019 when an employee installing trusses was exposed to a fall while standing on the top of a step ladder. To abate this violation, the employer must ensure that employees do not use the top or top step of stepladders. This employer has been previously cited for this practice that included: Steve Fischer Construction, LLC was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1926.1053(b)(13), which was contained in OSHA inspection number 1257487, citation number 1, item number 2 and was affirmed as a final order on November 8, 2017, with respect to a workplace located at 1066 Winneconne Av. Unit 8, Neenah, WI 54956. Steve Fischer Construction, LLC was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1926.1053(b)(13), which was contained in OSHA inspection number 1059671, citation number 2, item number 2 and was affirmed as a final order on August 3, 2015, with respect to a workplace located at W6474 Moon Shadow Drive, Greenville, WI 54942.
