29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. (a) The employer is failing to protect employees from excavated materials that could pose a hazard by falling into excavations where employees are working. This was most documented during the inspection conducted on May 07, 2019 at a worksite located on the Iowa Army Ammunition Plant at 17571 DMC Hwy 79, Middletown, IA 52638. Employees were working in an approximately 20 foot long by 7 foot depth trench. The spoils piles were located along both sides of the trench and the spoil pile to the right of the excavator was not located at least 2 feet of the edge, posing cave-in hazards.
