29 CFR 1910.119(d)(3)(ii): The employer did not document that equipment complied with recognized and generally accepted good engineering practices: a) Spiral freezer evaporator coils 1-4 roof: The employer failed to document that the configuration of the pressure relief valves for spiral freezer evaporator coils 1-4, complied with RAGAGEP such as, but not limited to IIAR-2 2014 15.5.1.5. The termination of the discharge was positioned horizontally and in the event of a release from the pressure relief valves, ammonia would be discharged and directed horizontally rather than vertically potentially exposing employees or contractors inspecting or working on the units to the hazards of toxic vapor inhalation and/or chemical vapor burns, on or about 4/10/19. b) Ammonia refrigeration system: The employer failed to document that the ammonia leak detectors and alarms complied with RAGAGEP, such as, but not limited to, IIAR 2 2014 section 17.2. There was no back up power for the detectors and alarms in the event of a power loss exposing employees or contractors to the hazards of toxic vapor inhalation and/or chemical burns, on or about 5/24/19. c) Ammonia refrigeration system: The employer failed to document that the ammonia leak detectors and alarms complied with RAGAGEP, such as, but not limited to, IIAR 2 2014 section 6.13.1. The ammonia leak detectors alarmed at 50 PPM exposing employees to the hazards of toxic vapor inhalation and/or chemical burns, on or about 4/10/19. d) Spiral freezer: The employer failed to document that surge drums 1-4 complied with RAGAGEP, such as, but not limited to, IIAR 109 section 4.2.1. The drums were not anchored to the floor to prevent the transmission of the vibration from the fans which resulted in an ammonia release, on or about 3/28/19. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
