29 CFR 1910.23(c)(8) The employer did not ensure that the top cap and the top step of a step ladder were not used as steps: (a) This violation occurred on March 20, 2019 in the axle installation department where a Louisville, 10 foot, A-frame, self-supporting ladder was being used by an employee to caulk the exterior seams of the house prior to painting. The employee was working while standing on the top step of the ladder and was exposed to a fall hazard of approximately 8 feet to the concrete floor below. (b) This violation occurred on March 20, 2019 in the plumbing testing department where a Werner, 6 foot, A-frame, self-supporting ladder was being used by an employee to mask off one of the exterior lights of the house prior to painting. The employee was working while standing on the top step of the ladder and was exposed to a fall hazard of approximately 4 feet to the concrete floor below.
