29 CFR 1910.147(c)(7)(i): The employer did not provide adequate training to ensure that the purpose and function of the energy control program was understood by employees: (a) Contractor or temporary workers engaged in performing maintenance and preventive maintenance on hard wired equipment such the North Carolina Line were exposed to crushing hazards. Inadequate lockout / tagout training was provided. No lockout / tagout was being used when a contractor or temporary worker was crushed by the unloading track of the North Carolina Line. (b) Contractor or temporary employee(s) engaged in performing maintenance and preventive maintenance on hard wired equipment such the North Carolina Line were exposed to crushing hazards. Inadequate lockout / tagout training for company employee(s) responsible for hiring outside personnel. The company's management employee(s) did not do the following: 1) Conduct a pre-job meeting to review all applicable lockout / tagout procedures for the job. 2) Obtain a copy of the contractor or temporary worker's lockout / tagout program. 3) Obtain a copy of the contractor or temporary worker's lockout / tagout program training documentation. 4) Determine if the contractor or temporary worker had lockout / tagout devices to isolate and control all energy sources.
