29 CFR 1926.502(a)(2): Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection. The employer does not protect employees from falls by providing necessary fall protection. The most recent incident of such failure occurred on November 12, 2018, at 11141 Spinner Avenue, Sharonville, a church and school building, the employer did not provide and install fall protection systems before the tear off and shingling of the 6/12 pitch steep roof of the church and school building. Hernandez Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard (name previously cited standard), which was contained in OSHA inspection number 1297758, citation number 1, item number 2 and was affirmed as a final order on June 19, 2018, with respect to a workplace located at 9040 Debbie Drive, West Chester, OH 45069.
