29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions had been taken to ensure their safety The employer is failing to protect employees from struck-by and engulfment hazards. This was most recently documented on or about October 16, 2018 at a jobsite near 5380 Westwood Drive, Weldon Springs, Missouri. (a) The competent person authorized employees to enter an unprotected excavation with a Type B soil. The trench measured approximately six feet five inches (6'.5") in depth, Nine feet (9') in width and fifty six feet (56') in length. No protective system was located on the jobsite. (b) The competent person authorized employees to enter the excavation without providing a unimpeded safe access and egress path.
