29 CFR 1926.21(b): Employer responsibility. 29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a.) Located at the 1175 Bobcat Avenue Goddard School worksite in Grandview Heights, Ohio: On or about October 9, 2018, the employer failed to instruct employees regarding unsafe conditions, the recognition of the hazards associated with those unsafe conditions, and the avoidance of unsafe conditions associated with the work environment . Additionally, the employer failed to provide training or instruction in the regulations applicable to this work environment contained in 29 CFR 1926, such as but not limited to, the OSHA trenching and excavation standards. Due to these conditions, employees performed work in excavations/trenches up to 14 feet deep without cave-in protection.
