29 CFR 1910.120(q)(6)(ii): First responders at the operational level did not receive at least eight hours of training or did not have sufficient experience to objectively demonstrate competency in the areas required by 29 CFR 1910.120(q)(6)(ii)(A) through (q)(6)(ii)(F) and/or the employer did not so certify: (a) 55 Hosier Street, Warehouse #1, Selbyville, DE - On or about July 12, 2018, the employer failed to ensure that employees who participated in an emergency response event involving a greater than incidental release of a hazardous substance had sufficient training or experience to perform the role of a first responder at the operations level. Employees engaged in containment activities, including the application of absorbent materials to contain an uncontrolled spill of approximately 300 gallons of Peracetic Acid, were not appropriately trained to perform actions at the operations level.
