29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury: The employer is failing to instruct and train employees to recognize, avoid, and prevent potential caught-between, caught-under, and struck-by hazards associated with trenching and excavations. The was most recently documented on January 30, 2018 at or near 16 Hawk Ridge Court, Lake Saint Louis, MO 63367, where the employer had not instructed and trained employees to recognize, avoid, control or eliminate unsafe conditions and hazards relating to the following: a) Lack of cave-in protective systems for employees in an 11-foot deep trench. b) Workers were not removed from hazardous trench conditions until the trench conditions were corrected. c) Spoil pile was not placed 2 feet back from the face of the excavation. d) Workers did not wear protective helmets when objects above created struck by hazards. e) Workers did not have suitable means of egress.
