29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): The employer is failing to protect employees from struck-by hazards when employees operate powered industrial truck(s). This was most recently documented at 2314 E Hwy 30, Grand Island, NE 68802 on February 6, 2018 and at times prior when employees operated the forklift (Nissan, model # PJ02A25PV, serial # PJ02-9H2763) without receiving either initial operator training and evaluation, or a refresher training and evaluation at least once every three years thereafter.
