29 CFR 1910.146(c)(1): The employer did not evaluate the workplace to determine if any spaces were permit-required confined spaces: On or about November 9, 2017, the employer failed to determine if confined spaces such as residential septic tanks that they regularly service and repair were a permit required space. Atmospheric testing was not performed to test for known hazards such as but not limited to methane gas build up. Employees who service septic tanks have to cross the plain of the tank once the cover is removed to perform miscellaneous inspection and repair. At times, employees have to lean approximately 3 or more feet inside of the tank from the surface level.
