North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees condition of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)Vehicles used to transport employees shall have seats firmly secured and adequate for the number of employees to be carried. Seat belts and anchorages meeting requirements of 49 CFR Part 571 (Department of Transportation, Federal Motor Vehicle Safety Standards) shall be installed in all vehicles. Lack of seats and seat belts is the proximate cause of the deaths of Mr. Rafael Gamaz, and Mr. Fransisco Sanchez, as well as the injuries of Mr. Ruben Rivera. Among other methods, one feasible and acceptable abatement method is to install a seat and seat belt for each worker to be transported in the bed of the truck thus protecting workers from falling or jumping off the truck at highway speeds.
