29 CFR 1910.178(m)(5)(iii): When the operator of an industrial truck is dismounted and within 25 ft. of the truck still in his view, the load engaging means shall be fully lowered, controls neutralized, and the brakes set to prevent movement. On July 16, 2017 located at the DAAV Maintenance Facility, an employee was working alone had dismounted within 25 of the a Hyster Forklift Model # H40XM leaving the 2075 pound sheet metal pan brake suspended on the forklift causing a potential crushing hazard. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
