Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that workers were exposed to crushing injuries while operating mechanical press brakes that were inadequately maintained: MANUFACTURING DEPT: The employer did not establish and implement a program of periodic and regular inspections of power press brakes. On or about October 24, 2002, the ram slide of Chicago Press Brake, Model 80C, Serial Number L15045 fell off from the press brake due to lack of programs of inspections and maintenance, and an employee sustained an injury from the incident. Among other methods, one feasible and acceptable method to correct the hazard is to establish and follow a program of periodic and regular inspections of power press brakes and to maintain records of the inspection as required by section 5 of the American National Standards Institute (ANSI) B11.3-1982 for Power Press Brakes Safety Requirements.
