29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. (a) Employees working in an excavation located along Myrtle Avenue between 11th Street and 12th Street in Boise, ID measuring 80' long by approximately 7.5' and approximately 6.7'-7.7' deep on or about May 3, 2017, and at times prior thereto, had not been removed when the presence of information that clearly showed hazards were present. NOTE: Abatement certification AND supporting documentation are required for this item.
