29 CFR 1910.269(w)(5)(i): Whenever an employee may be pulled or pushed, or might fall, into water where the danger of drowning exists, the employer did not provide the employee with, and did not ensure that the employee uses, a U.S. Coast Guard approved personal flotation device. On or about April 22, 2017, the employer did not ensure the employees exposed to a water hazard used a personal floatation device and an employee fell approximately 10-feet into the Mississippi River while driving across the Hamilton Dam in a powered vehicle when the vehicle veered off the unprotected upstream side of the dam.
