Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees operating heavy equipment were exposed to impact injuries from a vehicle accident as a result of unauthorized modifications to the equipment.: (a) Location: Dudley Road, Bedford, MA; On or about 4/4/96, the Case Front End Loader, ID #17042799, was modified without the written manufacturers approval, such that a plastic 55 gallon container was filled with concrete and attached to the rear of this machine affecting the operational and braking capacities of the vehicle. One feasible and acceptable means to correct this hazard is to obtain written permission from the manufacturer prior to making any modifications to heavy equipment.
