Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazard. In the Tool and Die department, the Budgit overhead hoist, 1/2 ton capacity, was used to lift die weighing in range from 400-1200 pounds, had a rating marked 250 lb. capacity on the girder of the hoist and on the motor of the hoist a marking of 1000 lbs. Feasible and acceptable abatement methods to correct this hazard is to comply with the safe operating procedures recommended by ASME/ANSI B30. 16-1.1.1 such as (but not limited to): Contracting with a crane/hoist company to measure the capacity of the hoist.ty
