OSH ACT of 1970 Section (5)(a)(1): The employer does not furnish employment and a place of employment which are free from recognized hazards that are causing or likely to cause death or serious physical harm to employees due to the delayed medical attention for serious workplace injuries beyond first aid. Location: Facility a) This violation occurred on October 31st, 2016, when an employee was struck in the cheek by a nail from a nail gun. No ambulance was called, thus delaying the employee from receiving prompt medical attention. To abate this violation, the employer must ensure that prompt medical attention such as 911 or emergency medical services is called when employees are injured on site. Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance.
