29 CFR 1910.95(k)(1): The employer did not train each employee who is exposed to noise at or above an 8-hour time-weighted average of 85 decibels in accordance with the requirements of 29 CFR 1910.95(k). The employer did not institute a training program and ensure employee participation in the program: a) Throughout facility - On or about 10/24/2016, employees were exposed to continuous noise at 85.6% of the permissible daily exposure of 85 dBA (8 hour time weighted average) or equivalent sound levels of 89 dBA during 380 minutes sampling period on November 2, 2016. The exposure calculation included a zero increment of the 100 minutes not sampled. The training program was not provided to employees while operating machines such as, but not limited to FM-46, NYS-009, Cuttoff#1 and Automated Cell. b) Throughout facility - On or about 10/24/2016, employees were exposed to continuous noise at 75.8% of the permissible daily exposure of 85 dBA (8 hour time weighted average) or equivalent sound levels of 88 dBA during 380 minutes sampling period on November 2, 2016. The exposure calculation included a zero increment of the 100 minutes not sampled. The training program was not provided to employees while operating machines such as, but not limited to FM-46, NYS-009, Cuttoff#1 and Automated Cell.
