29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: a) At the site, where the designated competent person was not competent in that he was not able to correctly calculate the slope of the excavation and he was not familiar with the requirements contained in Subpart X for the construction of stairways, exposing employees to caught-in and fall hazards.
