Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being run over, caught in or struck by farm equipment: (a)Near the intersection of Casa Blanca and Secate Road, Bapchule, Arizona - On 7/4/2004, an employee was run over by a tractor wagon. Farm crew performing corn picking operations were told that they could take a nap while a farm tractor was under repair. The employer did not ensure that all crew members were accounted for before starting and moving farm equipment, exposing employees to the hazard of being run over, caught in or struck by the farm equipment. Among other methods, a feasible and acceptable means to abate this hazard is: 1.To prohibit employees from sleeping under or near farm equipment, and 2.To ensure that all crew members are in a safe place before starting or moving farm equipment, and 3.To train employees and enforce work rules.
