Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to biological contamination (animal feces) by being permitted to eat in unsanitary locations: Employees were permitted to consume food and beverages in manure trucks contaminated with animal feces. In the following instances noted during the inspection, work crews were not provided sanitary eating facilities: a)Brooder Barn #5 - On or about 06/15/00 a sanitation crew employee performing manure clean-out of a barn was not provided sanitary eating facilities and was permitted to consume food and beverages in manure trucks contaminated with animal feces. b)Plant #4, Barn 42 - On or about 06/16/00 a wash crew employee performing barn washing and manure clean-out with a Bobcat loader was not provided sanitary eating facilities and was permitted to consume food and beverages in manure trucks contaminated with animal feces. c)Plant #4, Barn 42 - On or about 06/16/00 a wash crew employee performing barn washing and manure clean-out with Bobcat loader was not provided sanitary eating facilities and was permitted to consume food and beverages in manure trucks contaminated with animal feces. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide and enforce of use of washing facilities and sanitary eating location.
