29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel: (a) The TCM forklift had the key broken off in the ignition switch and had not been taken out of service until it was repaired. (b) The Yale forklift had the shift lever tied up using nylon plastic cable ties and had not been taken out of service until repaired.
