29 CFR 1904.7(b)(3)(iv): Weekend days, holidays, vacation days or other days off are not included in the total number of days recorded if the employee would not have been able to work on those days because of a work-related injury or illness. The employer is failing to report loss work days. This was most recently documented on or about May 17, 2016 at Magna Seating dba Excelsior Springs Seating System located at 301 South McCleary Road, Excelsior Springs, Missouri. The employer failed to count the number of calendar days the employee was unable to work as a result of injury or illness, regardless of whether or not the employee was scheduled to work on those days, to include weekend days, holidays, vacation days or other days off. a) An Assembler Employee log #15-043 had surgery on April 8, 2016 from an injury in June 2015 and was able to return to work on April 10, 2016 per doctors restrictions; no loss days were recorded.
