29 CFR 1926.416(a)(3): Before work is begun the employer shall ascertain by inquiry or direct observation, or by instruments, whether any part of an energized electric power circuit, exposed or concealed, is so located that the performance of the work may bring any person, tool, or machine into physical or electrical contact with the electric power circuit. The employer shall post and maintain proper warning signs where such a circuit exists. The employer shall advise employees of the location of such lines, the hazards involved, and the protective measures to be taken. Located on the south side of a commercial structure, employees utilizing Werner extension ladders to perform EIFS work were exposed to electrical shock while working near 7, 200 voltage energized power lines that were not properly posted with a warning sign. The employees had not been advised by the employer of the location of the electrical lines, hazards involved, and protective measures to take to minimize these hazards. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
