Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from an unsecured work platform being moved while in an elevated position by a powered industrial truck: (a)Frozen Repack Plant - An employee sanitizing walls while standing on a platform supported by the forks of a lift truck was exposed to a fall hazard when the lift driver was backing up with the platform in an elevated position, approximately twenty (20) feet high, as occurred June 27, 1998. Among other methods, one feasible and acceptable method to correct this hazard is to utilize a scissors lift or an aerial basket type lift.
