Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees did not have a formal documented preventative maintenance and inspection program: An employee working on the Worthington Ridge residential Construction project was exposed to potential injury while operating a tractor that had been returned from prolonged storage to service without having a formal documented inspection. One feasible abatement method to correct this hazard is implement and maintain a formal documented program for the inspection of equipment prior to each use.
