29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toe-boards: Note: Toe-boards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard. a. In the Paint Line area, the Southern end of the work platform located above the Paint Line, at approximately 12 ft. above the surface level, did not have a top guardrail installed. b. In the Paint Line area, the West side of the work platform located above the Paint Line, at approximately 12 ft. above the surface level, had an unprotected edge approximately three feet long.
