Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling load hazards from the one (1) ton Coffing electric hoist as it had its lifting chain wrapped around the load and was being used as a sling. (a)Utility Area - The Coffing one (1) ton electric hoist had its hoist chain wrapped around the load and was being used as a sling device to lift the load.
