Text For Citation: 01 Item/Group: 002 Hazard: CHEMICAL
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)The employer failed to keep the workplace free from the hazard of chemical incompatibility during an uncontrolled release of Muriatic acid from Tank #20 in that the dike built under the tank was not positioned properly to completely contain an uncontrolled release from the south side of the tank. ABATEMENT METHOD: Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide a containment barrier located around the tank such that all leakage would be contained within the dike. (b)The employer failed to keep the workplace free from the hazards of chemical incompatibility during an uncontrolled release of Muriatic acid from Tank #20 in that metal tanks and drums containing chemicals such as, but not limited to, Diesel fuel, Gasoline fuel, and unknown hazardous waste residue were positioned inside the dike built under Tank #20. ABATEMENT METHOD: Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure the containment barrier located around the tank does not contain any materials such as, but not limited to metal tanks containing incompatible chemicals.
