29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a. At the construction site, 11437 River Hills Rd., Festus, MO, a stairwell opening was not protected by a cover or guardrail on October 21, 2015, and at other times during construction work exposing employees to a fall hazard. b. At the construction site, 11437 River Hills Rd., Festus, MO, at the north side, first floor of the building, there was a 10 to 12 ft. fall hazard from the floor to the ground below. Prior to and on October 21, 2015, no guardrail or any other fall protection was installed at this unprotected side, which was the day a fall injury had occurred at another location at the construction site. c. At the construction site, 11437 River Hills Rd., Festus, MO, at the north side, first floor of the building, where there were window openings 18" from the inside floor, there was a 10 to 12 ft fall hazard from the window openings to the ground below. Prior to and on October 21, 2015, no guardrail or any other fall protection was installed at the window openings, which was the day a fall injury had occurred at another location at the construction site.
