29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): a) The employer does not ensure that each employee operating rough terrain forklifts is trained and evaluated in the safe operation of the equipment. This violation was most recently observed at the property 1427 Kater St., Philadelphia, PA 19146 on October 27, 2015, where employees were engaged in constructing a new residential home and using the rough terrain forklift to deliver materials to the working levels without the proper training. To abate this ongoing violation, the employer must ensure that each employee is trained and evaluated on the safe operation of the equipment.
