29 CFR 1910.178(l)(1)(ii) This provision is applicable to construction employment by 29 CFR 1926.602(d). 29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a power industrial truck: Worksite located at 7390 West Middle Road, Raymond, NE: The employer failed to ensure that the employees operating a JLG allterrain powered industrial truck to elevate a personnel platform and move materials in and around the construction site had training on the hazards associated with operating all-terrain powered industrial trucks. Abatement certification is required for this violation. The abatement certification sheet is enclosed with the citations.
