Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: S/C pinch and shear point hazards created between the elevator car and hoistway landings. One feasible and acceptable method, among others to correct this hazard is to provide the elevators with anti-creep leveling device to conform with ANSI/ASME A17.3-1986, part IV sec. 4.7.3 a) 568 Broadway Crosby Street side - sub-basement to 12th floor - Elevators #1, 2, 5, and 6 were not provided with anti-creep self leveling devices.
