Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by a moving vehicle: Among other methods, one feasible and acceptable abatement method to correct this hazard is to repair the defective brakes as indicated by the manufacturers manual. Yard Area - The international harvester boom truck was not in compliance with Section 5(a)(1) of the OSH Act of 1970 in that the brakes were inoperative: a) 1957 Intl. Harvester boom trucks; three axle, with 1000 gallon water tank. b) Yard Area c) Fractures and possible death from being struck by d) Visual observations
