Text For Citation: 01 Item/Group: 002 Hazard: FALLING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Outdoors at the rail siding: Employees who must walk on the top of the rail cars to install or move the hatch opening filters, were exposed to the hazard of falling from the top of the cars to the ground approximately 12 feet below. Among other methods, one feasible and acceptable abatement method would be to erect a horizontal cable suspended above the rail cars that was of sufficient strength to be used as an attachment point for a lanyard to a safety belt worn by employees whenever they must walk on the tops of the rail cars.
