29 CFR 1910.22(c): Covers and/or guardrails were not provided to protect personnel from the hazards of open pits, tanks, vats, ditches, etc. (a) At the asphalt mixing drum, directly beside the maintenance access hatch, there was a earthen ditch approximately four feet deep extending from under the mixing drum and into the walking working area.
