29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. a) On or about October 7, 2011 and at times prior, Kelley Trucking Inc did not ensure that employees were protected from falling rock hazards. The competent person on site did not remove the crew from the hazardous area when the following instances were recognized. 1. Rocks had been falling from the slope face since the project began. 2. The wire mesh, placed to stabalize the face, did not extend to the area directly above where the reinforced buttress wall was being constructed. 3. The extensive work done at the top of the job had left loose rock on the slope face. 4. The rain, falling that day, was a destabilizing factor to any loose materials on the slope face.
