Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) The hazards of being struck by a tree - Bottle Creek Drainage, Bottle Creek Timber Sale near Avery, Idaho - On or about April 16, 1991 and at times prior thereto, choker setters falling trees on the landing deck did not maintain a safe minimum working distance of two tree lengths between employees. Among other methods, one feasible and acceptable abatement method to correct this hazard is to train all employees in the safety precautions required when falling trees and always require a two tree length separa- tion between falling operations.
