Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of infection by HIV and/or HBV through direct contact with bood and body fluids: (a) Appropriate medical follow-up procedures were not implemented for the laundry workers after exposure to the hazard of being infected with HIV and HBV through contact with sharps in the linen. Feasible and useful method(s) of abatement for reducing the hazard among others, are: (1) Through the consulting physician provide immediate, confidential evaluation and any recommended follow-up testing and/or treatment.
